Overview:

Framework agreement is a strategic/long-term agreement with suppliers, contractors and service providers which sets out terms and conditions under which specific procurements (call-offs) can be made throughout the term of the agreement.

Framework agreements are generally based on prices that are either pre-agreed or determined at the call-off stage through competition or a process allowing their revision without further competition.

√ Section 34A of Act 663 as amended provides for the use of framework contracting/agreements where the context permits and this shall be in accordance with the guidelines issued by the PPA.

√ Framework agreement is not a method of procurement but a contracting arrangement which could be used after the conclusion of any method of procurement.

√ Framework agreements are particularly suitable when procuring recurrent items or common user items over a prolonged period (three years)

Objectives of the Training Programme:

 

  1. Explain the concept of Framework contracting.
  2. State the benefits of framework contracting in improving efficiency and the achievement of Value for Money in Public Procurement
  3. Explain the mechanisms in the formation of Framework Agreements in public procurement.
  4. Identify possible challenges in the management of framework Agreements and associated contracts.

The training methodology will employ adult learning techniques like building on participants’ experiences and engaging them in reflective processes such that participants can discover by themselves and adopt practical application of various concepts taught. To build a more robust oversight function of public entities, the Government of Ghana with funding from the European Union (EU) developed a Standardized Procurement Audit Framework (SPAF) to improve and coordinate procurement audit of the Ghana Audit Service (GAS), Internal Audit Agency (IAA) and Public Procurement Authority (PPA). This training is to build the capacity of participants to enable participants to carry out internal, external and specific audits into the procurement activities of entities and compliance by contractors, suppliers, and consultants.

  • Explain the objectives and procedures used by PPA, GAS and IAA to undertake their legal mandates.

Gambia Public Procurement Authority (GPPA) visits Ghana https://ppa.gov.gh/gambia-public-procurement-authority-gppa-visits-ghana/ Fri, 16 Jun 2023 13:52:37 +0000 https://ppa.gov.gh/?p=6307 A 13-member delegation from the Gambia Public Procurement Authority (GPPA) visited Ghana from Monday 5th June through Wednesday 14th June 2023 to study Ghana’s Electronic Procurement System (GHANEPS).

The study tour took place in Sunyani, the Bono Region, the PPA Head Office and the GHANEPS Secretariat.

The deputy CEO of PPA, Mr Kwame Prempeh, said he was delighted that the PPA had been chosen as the final destination of their study tour after visiting Rwanda and Nigeria.

“Many African countries are adopting electronic procurement systems to improve public sector governance. By the end of this year, GHANEPS will be the only way to conduct procurement in Ghana. Ghana’s adoption of electronic procurement will generate enormous benefits for the government, procurement practitioners as well as the private sector. Both regulatory authorities will also have the opportunity to exchange best practices and share lessons learned from the visit” Mr. Kwame Prempeh stated.

According to the Director General of the GPPA, Ghana was chosen as part of the study tour because it has successfully implemented efficient and effective e-procurement systems.

“The objective of the Study Tour is to learn and benefit from the experiences of countries with a proven record in transforming and modernizing their procurement systems through setting up effective project governance structures and implementing e-procurement” he stated.

The delegation was made up of the Director General of the GPPA, Phoday M. Jaiteh, the Executive Secretary of the Gambia Competition & Consumer Protection Commission, Amadou Ceesay, a procurement specialist of the Gambia Fiscal Management Development Project, Ngenarr Sosseh, Director Compliance & Procurement Practices, Samba Tambura, Procurement Officer – Directorate of the Public Procurement, Isatou Mbenga, Finance Manager (GPPA), Ebrima Darboe, Human Resource Manager (GPPA), Alieu Y. Kah, Principal IT Officer (GPPA), Foday Jorh, Principal IT Officer (GPPA), Alieu Bangura, Principal IT Officer (GPPA), Mamadou Jallow, Senior Compliance Officer (GPPA), Jamila Maame Esi Odoom, Audit Supervisor (GPPA), Mustapha Njie, and Compliance Assistant (GPPA), Muhammed Sawaneh

As part of the activities for the study tour, the delegation participated in a five-day training on GHANEPS in Sunyani, a two-day presentation on PPA’s activities, a visit to the Food and Drugs Authority (FDA), and a visit to the GHANEPS Secretariat.

Background:

The system for e-GP in Ghana is known as GHANEPS (Ghana Electronic Procurement System). Its implementation originates from June 2011 when PriceWaterHouse Coopers (PwC) was engaged as consultants for the systematic development of an e-GP in Ghana. They developed the strategic plan for the implementation. In 2017, a firm was chosen through an international competitive tendering process to partner with the government in providing a system with full end-to-end e-GP functionalities. The application was developed with the input of five pilot Government Entities. The five selected entities were the Department of Feeder Roads, Ghana Cocoa Board, Ghana Health Service, Koforidua Technical University and Tema Metropolitan Assembly. On 30th April 2019, Vice President His Excellency Dr Mahamudu Bawumia launched GHANEPS. The first phase (I) of the implementation culminated in a six-month pilot run with the five entities. In November 2019, the Phase II of the implementation was initiated, with the objective of rolling the system out to all government entities in Ghana. As part of the rollout, public entities and the private sector are sensitized, trained, and supported in the use of the system. The Roll-Out is being carried out in a phased approach and is targeted to be completed by the end of this year.

PPRA Botswana visits Ghana https://ppa.gov.gh/ppra-botswana-visits-ghana/ Fri, 10 Mar 2023 16:08:40 +0000 https://ppa.gov.gh/?p=6260 On Tuesday 7th March 2023 the Public Procurement Authority (PPA) hosted a 6-member delegation from the Public Procurement Regulatory Authority, Botswana who are on a Benchmarking visit.

In his welcome address, the CEO of PPA Mr Frank Mante was pleased that the PPA was their choice of destination for their Benchmarking Visit. He indicated that the visit would offer both regulatory authorities the opportunity to learn and share best country practices and experiences.

This year marks the 20th anniversary of Act 663, so we have a lot of experience and best practices to share. “Our doors are always open beyond this 4-day visit,” he said.

In response, the Board Chairperson stated that the PPRA is still in its infancy when it comes to Public Procurement, which is why it needs to learn from and establish strong ties with experienced regulatory bodies like the PPA.

The delegation was made up of the Board Chairperson of PPRA, Gerald N. Thipe, the Acting Chief Executive, Tumelo Motsumi, Board Secretary Patience Motswogole, Acting Director Works, Augustine Tema, Devolution & Compliance Coordinator, Lefoko Ramoatlhodi and Capacity Building Coordinator Lisani D. Nzhuzhu.

The delegation was taken through key areas such as Professionalism of Procurement, Capacity Building, Compliance, Monitoring and Evaluation, Supplier Registration, Procurement Administrative Review and Sanctions, Sustainable Public Procurement, Electronic Public Procurement, Procurement Audit, and Inspections among others.

The delegation also visited other public entities such as Ghana Gas, Ghana Audit Service and the University of Ghana. In all these institutions, the team were taken through their procurement system and process.

It is also the time when we set some resolutions for the near or long term.  Let me first take this opportunity to thank the Board, Management, and Staff of the Public Procurement Authority (PPA) for the efforts they put in achieving most of our objectives as per our core mandates. I am happy we tackled a challenging year and turned it into a successful one. Your hard work is greatly appreciated.

The training programmes would help procurement practitioners purchase goods, works and services that will reduce adverse environmental impact and help achieve sustainable goals.

Speaking at the opening ceremony, Mr. Frank Mante, the CEO of the Public Procurement Authority (PPA) said, the impact of sustainable procurement should be considered by all practitioners because of the greater benefits not only to organizations but also the country thus minimizing the damage to the environment. He advised practitioners who do not have a SPP plan to consider it, and those who have an SPP plan in operation should improve its existing practices.

Operationalizing Sustainable Public Procurement (SPP) is an opportunity to move the country towards innovation and sustainability. Countries who have dedicated their time and resources towards sustainability are achieving great rewards and Ghana can also achieve its sustainable goals through public procurement” he stated.

The participants of the two-day workshop were taken through topics such as Understanding the Sustainability Principles, Overview of the SPP Policy for entities, The need for SPP, Life Cycle Impact Mapping and Product Specification, Supplier Selection, Tender Evaluation and Life Cycle Costing.

Participants of the training were from entities such as Ministry of Finance, Bank of Ghana, Ghana Exim Bank, Ghana Civil Aviation Authority and Lands and Natural Resources among others.

The four-day training workshop in Koforidua for procurement practitioners will help the practitioners gain insights in tender preparation and evaluation for goods and technical services.

The training programmes which seek to build the capacity of public officers in public procurement in public entities is scheduled for July-August 2022 and will take place in Accra, Koforidua, and Tamale. It will cover topics such as Legal Framework of the Public Procurement Act, 2003, Act 663 as amended, Contract Administration for Goods and Technical Services, Contract Administration for Works and Consultancy Services, Effective Tender Preparation and Evaluation of Goods and Technical Services, Sustainable Public Procurement, Public Procurement and Submitting a winning Tender.

Speaking at the opening ceremony, the Chief Executive Officer, Mr Frank Mante stated that this training is needed to build the capacity of officers so they can embark on public procurement efficiently and effectively.
